Terms of Service
Effective date: September 15, 2026
Plumbing services in North Carolina
1. About these terms
These Terms of Service explain how Silver Brook Plumbing (“we,” “us,” or “our”) provides plumbing services and handles estimates, payment, scheduling, and warranty requests. Our legal business identity and contact information appear in Section 19.
For a service order, these Terms become part of our agreement when we provide them or a clear link to them before you authorize the work and you accept them with the quote or service authorization. Acceptance may be by signature, electronic approval (including a clear SMS or email response), or another legally effective method. Merely visiting our website or submitting an inquiry does not authorize work or create a payment obligation.
A service order may be recorded in an accepted quote, a booking confirmation reflecting your affirmative authorization, or an SMS or email exchange identifying the agreed service and price or pricing basis. Electronic approval requires an affirmative response reasonably attributable to you or your authorized representative; silence or message delivery alone is not approval. We retain the accepted order and applicable Terms version with our service records.
An accepted written quote or service agreement identifies the work and price for your project. A specifically agreed written project term controls over a conflicting general term here, subject to applicable law. An invoice documents agreed charges; it does not introduce new contractual terms after work has been authorized. Nothing in these Terms reduces rights that applicable law does not allow us to waive.
2. Services and service area
We provide plumbing repairs, installation, diagnostics, and maintenance in Cary, Raleigh, Morrisville, and other nearby North Carolina communities that we confirm at booking. Services may include faucets, toilets, showers, garbage disposals, drain cleaning, leak detection and repair, water and drain piping, shutoff valves, pressure-reducing valves, water filtration, and water heater services, including flushing.
We confirm the service address, requested work, and availability before accepting a job. We provide residential and commercial plumbing services within the scope of our North Carolina Plumbing Class I contractor license. Specialized services are available only when specifically confirmed and within our applicable licensing authority. Only the work described in your accepted service order is included.
4. Additional work and concealed conditions
Concealed leaks, deteriorated piping, inaccessible connections, prior improper work, code issues, or other conditions may require work outside the original scope. We will explain the condition, proposed additional work, and price or pricing basis, and obtain your approval before performing that additional work or exceeding an agreed spending limit. Approval will be documented in a change order, email, text message, or other written record.
If applicable code, permit conditions, inspection findings, manufacturer installation instructions, or safety requirements make additional work necessary to complete the authorized work lawfully and properly, we will explain the requirement and obtain your approval before performing work outside the agreed scope or incurring additional charges. We are not required to perform work in a manner that violates applicable requirements. This provision does not, by itself, increase an accepted fixed price or authorize a charge to correct our defective or noncompliant work.
If approval is not obtained, we may pause the affected work and explain any remaining safety concerns. You remain responsible for authorized work properly performed and other previously agreed, lawful charges, subject to applicable cancellation rights. Discovery of concealed conditions does not itself authorize extra charges or excuse defective work.
A diagnostic visit or limited repair is not a complete inspection or certification of the entire plumbing system. We will explain material limitations of the agreed investigation or repair that become apparent to us.
5. Service calls, payments, deposits, and taxes
Payment is due when the authorized services are completed and the invoice is provided, unless we agree in writing to a different schedule before work begins. We accept cash, checks, and major credit cards. Any additional payment methods will be identified when available.
A service call is a visit for the agreed initial assessment of the reported plumbing issue at a fixed fee. Before booking, we will explain the fee, what assessment it includes, applicable taxes, and payment timing. Additional testing, disassembly, or other work outside that assessment requires separate disclosure and approval before additional charges are incurred. Unless we agree otherwise in writing, the service-call fee is due when the agreed service call is completed and the invoice is provided.
Booking a service call authorizes the agreed visit and assessment, but does not by itself authorize a repair. If we can offer a repair, we will explain its scope and price or pricing basis, show how the service-call fee will be applied, and obtain your approval before starting it. Approval may be given on site or remotely as provided in Section 1. A service call does not guarantee that a repair can be offered or completed during the same visit.
If you authorize us to carry out the repair arising from that service call, the full service-call fee is applied toward the agreed total price of that repair order. The fee is included in that total and is not charged again on top of it. Any service-call amount already paid is shown as a payment toward the order, reducing the remaining balance once. The quote or invoice will identify the total price, the amount applied, and the balance due, with taxes handled as described below.
If you decline the repair, or we cannot offer one, the agreed service-call fee remains payable for the visit and assessment actually completed as agreed. This is payment for the service call, not a penalty for declining a repair. Cancellation and refund rights under Sections 7 and 8, and remedies for services not provided or improperly performed, remain applicable.
A deposit or progress payment may be required for certain projects. The amount, due date, purpose, and applicable cancellation terms will be disclosed and agreed in writing before payment is requested. Deposits are credited toward the contract price and are not automatically nonrefundable.
Repair, maintenance, and installation services to real property are generally subject to North Carolina sales and use tax unless an exemption or different statutory treatment applies. Qualifying capital improvements performed under real property contracts are treated differently under North Carolina law. Applicable taxes will be handled according to the classification of the transaction. Any sales tax legally chargeable to you will be disclosed and separately stated as required. For a qualifying real property contract, taxes on our materials are handled as required by law and are not presented as a separate sales tax on your contract price.
These Terms do not impose an automatic late fee, monthly interest charge, or collection fee. Any separately agreed payment charges must comply with applicable law. We retain lawful rights to seek payment, including lien rights where statutory requirements are satisfied. Attorney fees and collection costs may be recovered only to the extent authorized by applicable law and any valid agreement.
6. Scheduling, delays, and emergency availability
An appointment may be for a service call under Section 5 or for work already agreed under Section 3. We will confirm its purpose, the service address, and the appointment window. Agreeing on a time does not authorize unspecified repairs or undisclosed charges. Previously approved work need not be approved again merely because the order was agreed remotely; changes remain subject to Section 4.
Appointment times are estimated arrival windows unless we expressly agree otherwise. Earlier jobs, traffic, weather, parts availability, and inspection schedules may affect timing. We will make reasonable efforts to notify you of a material delay and arrange an updated time.
Subject to applicable law, we are not responsible for delays to the extent caused by circumstances beyond our reasonable control that we could not reasonably prevent or overcome, including supplier shortages or delays, utility interruptions, permit or inspection scheduling, and severe weather. Any resulting schedule extension will be limited to the time reasonably required. We will make reasonable efforts to reduce the delay, notify you of its effect, and arrange an updated schedule. This provision does not excuse delays caused by our negligence or breach of an agreed obligation, or remove any applicable cancellation or refund right.
Our extended emergency service hours are Monday through Friday, 7:00 a.m. to 9:00 p.m. Eastern Time, subject to technician availability. Availability, arrival time, and any additional charge must be confirmed. Submitting a website form or leaving a message does not confirm an emergency appointment.
For immediate danger to people, fire, or a suspected gas emergency, contact 911 or the appropriate utility emergency service from a safe location. Website messages are not an emergency response channel.
7. Cancellations and refunds
Please give at least 24 hours’ notice if you need to cancel or reschedule. A late cancellation, missed appointment, or failed-access fee applies only if its amount and triggering conditions were disclosed and accepted before booking and the charge is permitted by law. No automatic cancellation fee is created by these Terms.
Subject to any statutory cancellation rights, if you cancel an authorized project, we may charge for authorized work properly performed and reasonable, documented, nonrecoverable special-order or restocking costs that you approved before we incurred them. We will make reasonable efforts to avoid or reduce those costs and will not charge twice for a cost recovered through a return, credit, or other recovery.
We will provide an accounting of any deposit applied to lawful charges and refund the unused balance promptly, within any deadline required by law. If we cancel without your breach, we will refund payment for work not performed and items not supplied or transferred to you, subject to applicable law.
8. Statutory cancellation rights
Some qualifying transactions made at a customer's home or another off-premises location may carry a statutory right to cancel, including a three-business-day cancellation right in certain circumstances. Not every in-home service transaction qualifies; applicability depends on the nature of the transaction, how and where it was initiated and agreed upon, and any applicable statutory exceptions. When applicable, we will provide the required transaction-specific disclosures and cancellation forms. Those rights take priority over our scheduling, deposit, special-order, and cancellation provisions, and no fee or penalty will be imposed for exercising them.
These website Terms are not a substitute for a required cancellation notice or form. Requesting prompt or emergency service does not, by itself, waive a cancellation right. Any legally available emergency exception or waiver requires compliance with the applicable legal requirements and separate documentation where required.
9. Access, safety, permits, and suspension of work
You must be the property owner or have authority to approve the work and access to the property. Please provide safe, reasonable access; secure pets; and move personal belongings from the immediate work area where practicable. Tell us about known leaks, prior repairs, hazardous materials, private utility lines, wells, septic systems, and other relevant conditions.
We will exercise reasonable care to protect the property and take precautions appropriate to the work. Suspected hazardous materials may require evaluation by a qualified specialist before affected work can continue. Hazardous-material testing and abatement are outside our scope unless expressly agreed and lawfully authorized.
Where a permit is legally required for work within our scope, we will obtain or arrange for the permit as required by applicable law, unless responsibility is lawfully assigned to another party in writing. Any such allocation does not relieve us of duties that applicable law requires us to perform. We will verify that any required permit covering our work is in place before beginning work that requires it and coordinate required inspections for our scope with the responsible permit holder. Permit-related charges and any necessary work outside the original scope will be disclosed for approval. We retain our own legal duties regarding utility-location procedures and safe work practices; information requested from you does not transfer those duties.
We may pause affected work or decline a requested task if conditions are unsafe, reasonable access is unavailable, the task would violate applicable requirements, or necessary approvals have not been obtained. We may also pause work for an undisputed payment that is presently due under the agreed payment schedule, after written notice identifying the overdue amount and a reasonable opportunity to pay or resolve the issue. We will explain the reason and what is needed to resume work, and take reasonable protective steps required to avoid foreseeable harm from the suspension. Any charges or refunds remain subject to Sections 4, 7, and 8 and applicable law.
10. Product selection, materials, and manufacturer warranties
Parts, fixtures, and equipment are often selected and purchased specifically for your project based on compatibility, required specifications, availability, requested features, and your approved budget. An allowance is a budget allocation for an item whose final selection or cost has not yet been confirmed. We will identify any allowance and its pricing basis in the quote or estimate. An allowance does not guarantee the availability or price of a particular model.
Before placing a special order or incurring a nonrecoverable product cost for your project, we will identify the product or sufficiently specific selection criteria, the price or pricing basis and spending limit, and applicable nonreturnable or restocking terms, and obtain your approval in writing. Any charge upon cancellation is governed by Sections 7 and 8. A nonreturnable designation does not remove applicable rights concerning defective or incorrectly supplied products or statutory cancellation rights.
For an item covered by an estimate or allowance, we will obtain your approval of the final selection and any price adjustment before committing you to an additional cost. We will obtain approval before substituting a materially different product. Supplier price increases or shortages do not, by themselves, authorize us to change an accepted fixed price. Any change to an accepted fixed-price agreement requires a lawful, mutually agreed amendment as described in Section 3.
Manufacturer warranty coverage, if any, depends on the specific product and model supplied. Coverage, duration, eligibility and registration requirements, exclusions, and remedies are governed by the manufacturer’s applicable warranty terms. Where required by applicable law, we will make the written warranty for the selected product available for your review before you become obligated to purchase it from us, through a copy or another legally compliant means of access, and provide any required notice of its availability. An allowance or authorization to select a product does not waive these requirements. Any manufacturer warranty materials supplied with the product will be provided to you or otherwise made available with the applicable job documentation at installation or completion of the work, in a format permitted by applicable law.
Our workmanship warranty is separate from a manufacturer’s product warranty. We do not independently extend the manufacturer’s coverage. Manufacturer coverage may not include our labor for diagnosis, removal, transport, replacement, or reinstallation. We will disclose and obtain your approval for any such charge unless the work is covered by our workmanship warranty, another applicable warranty, or a legal obligation.
If you supply a fixture, part, or equipment, you are responsible for obtaining it and arranging any product warranty claim with its seller or manufacturer. We may decline to install a damaged, incomplete, unsuitable, incompatible, or noncompliant item. Additional labor, materials, or a return visit reasonably required because a customer-supplied item is defective, missing, incorrectly sized, or otherwise unsuitable are outside the original scope unless already included. We will disclose the price or pricing basis and obtain approval before incurring an additional charge. This does not authorize charges for our own errors or defective work. Our workmanship warranty still applies to our installation, and customer-supplied status does not excuse damage caused by our improper installation.
Nothing in this section disclaims an implied warranty or another obligation that applies to us as a seller or service provider under applicable law.
11. Limited workmanship warranty
We warrant our workmanship for 12 months from completion of the applicable service. This warranty covers defects in the labor we performed within the agreed scope at the original service address. If a covered workmanship defect is reported during that period, we will inspect and correct the affected workmanship without charge within a reasonable time. A longer workmanship warranty applies if we expressly provide one in writing.
Please contact us using the details in Section 19, describe the problem, and provide the service address and invoice number if available. Give us a reasonable opportunity to inspect and correct the work. A timely report remains eligible even if our inspection or correction takes place after the 12-month period ends.
The warranty does not cover a problem to the extent it is caused by misuse, improper maintenance, freezing, external pressure or water-quality conditions, ordinary wear, an unrelated pre-existing defect, or later work by someone else. An exclusion applies only to the extent that the stated cause, rather than our defective workmanship, caused the problem. Work by another provider does not automatically void the entire warranty.
The warranty covers our workmanship, rather than independent defects in a product. Product claims are addressed under Section 10. Routine maintenance and replacement of consumables are not included unless specified in your service order.
Take reasonable steps to prevent further damage when safe. If urgent protective work cannot reasonably wait for us, seek appropriate assistance and notify us as soon as practicable. Necessary emergency action does not automatically forfeit your rights. Responsibility for third-party costs depends on the circumstances and applicable law.
This warranty gives you specific legal rights, and you may also have other rights under applicable law. The 12-month coverage period does not shorten a legal deadline for bringing a claim or replace remedies otherwise available by law.
12. Drain cleaning, diagnostics, and maintenance
Drain cleaning addresses the obstruction and accessible piping described in the service order. It does not guarantee that a drain will remain clear for a particular period or repair roots, collapsed pipes, improper slope, or other underlying defects unless that corrective work is included. A new blockage or recurrence caused by an unresolved underlying condition is not, by itself, a workmanship defect. Our workmanship warranty and responsibility for reasonable care still apply.
Leak detection and other diagnostic services have limits that depend on access, system conditions, and the agreed scope of the diagnostic work. Water heater flushing, descaling, and other maintenance do not guarantee restoration of worn equipment or prevent future failure. If an existing component presents a material risk during the proposed procedure, we will explain the known risk and available options before proceeding.
Any temporary repair will be identified as temporary before you approve it, with its limitations explained. Our workmanship obligation applies to the agreed temporary work; the repair does not promise the performance of a permanent replacement.
13. Openings and restoration
Access to plumbing may require opening walls, ceilings, floors, cabinets, or landscaping. We will explain reasonably foreseeable access work before obtaining your approval. Unless expressly included in the accepted quote, finish restoration such as drywall finishing, painting, tile matching, cabinetry, and landscaping is arranged separately by you.
We will remove debris generated by our work and leave the immediate work area reasonably clean. An agreed exclusion of finish restoration does not excuse careless damage or omit sealing, firestopping, or other measures legally required as part of our plumbing work.
14. Responsibility for damage and certain losses
We are responsible for performing the agreed work with reasonable care and in compliance with applicable requirements. Responsibility for property damage or other loss will be determined under applicable law, including the cause of the loss and each party’s legal obligations.
Existing plumbing systems and connected components may contain concealed, aged, corroded, deteriorated, improperly installed, or previously damaged parts. Such a component may fail when reasonably operated, disconnected, accessed, or disturbed during otherwise proper plumbing work. We do not assume responsibility merely because an independent failure attributable to a pre-existing condition occurs during our work. A component’s age or condition does not, by itself, determine responsibility. This provision does not excuse damage caused or aggravated by our negligence, failure to exercise reasonable care, defective workmanship, or failure to perform an agreed obligation.
Please notify us promptly of a claimed service-related problem and, when reasonably practicable, allow us to inspect the condition before it is materially altered or repaired by another provider. Take reasonable steps to prevent further damage when safe. You do not need to delay reasonable emergency measures needed to protect people or property. Emergency work by another provider or an inability to arrange a prior inspection does not automatically forfeit a claim or shorten a legal filing deadline.
To the extent permitted by applicable law, we are not responsible for economic losses that are too remote, speculative, or unforeseeable to be legally recoverable. This applies to claimed lost profits, lost revenue, or business interruption only to the extent those losses meet that description; it is not a blanket exclusion of those categories of loss. This provision does not limit otherwise recoverable damages for bodily injury or physical property damage, or liability for gross negligence, willful or wanton misconduct, fraud, or any liability that cannot lawfully be limited.
Our workmanship warranty provides a service remedy in addition to other remedies available under applicable law. Damages and other remedies, if any, are determined under applicable law and the enforceable provisions of these Terms and any accepted service order. Except for the express warranties and specific obligations we undertake in these Terms or an accepted service order, these Terms do not expand our liability beyond that imposed by applicable law. Nothing in these Terms limits or waives any right or remedy that applicable law does not permit the parties to limit or waive.
15. Website information, communications, and service records
Our website provides general descriptions of services. Its information does not replace an assessment of your property or confirm that a particular repair is suitable. Use the website lawfully and do not interfere with its operation or submit false information.
We may use the contact details you provide to respond to your request and communicate about estimates, scheduling, work, invoices, and warranty matters, as permitted by law. Submitting a service request is not a blanket agreement to receive automated marketing calls or texts. Marketing consent, where required, is obtained separately. Our Privacy Policy explains how we handle personal information.
We may receive and retain descriptions, photographs, and other service information you provide, and take photographs and keep records of the work area, relevant existing conditions, equipment, model or serial information, and work in progress or completed work for estimating, service documentation, quality control, warranty, insurance, and resolving disputes, consistent with applicable law and our Privacy Policy. Documentation will be limited to what is reasonably relevant to these purposes, avoiding people and unrelated personal information where practicable. We may use photographs of completed work for our website portfolio, social media, Google Business Profile, and other promotional purposes when the images, captions, location tags, and associated metadata do not identify or reasonably enable others to identify you or your property and do not disclose your address or other personal or confidential information. We will obtain separate permission before using photographs or other service records for promotional purposes if they identify you or your property. This paragraph does not authorize audio recording.
Use of Google Maps and Google Places features and content available through our website is subject to the then-current Google Maps End User Additional Terms of Service (opens in a new tab) and the Google Privacy Policy (opens in a new tab). Those terms govern your use of Google’s features; our accepted service agreement governs the plumbing services we provide.
16. Concerns and dispute resolution
Please contact us promptly with any concern so we can review the work and attempt to resolve the issue. We encourage direct discussion, but these Terms do not require you to complete an informal process before exercising a legal right.
The parties may voluntarily agree to nonbinding mediation, including the mediator, location, and allocation of costs. These Terms do not require binding arbitration, waive a jury trial, or prevent either party from using an available small claims court, seeking urgent relief, contacting a regulator, or filing a claim within a legal deadline. Discussions or mediation do not automatically extend filing deadlines.
17. Governing law and severability
North Carolina law and applicable federal law govern these Terms and our North Carolina services. Any court proceeding must be brought in a court with jurisdiction and proper venue under applicable law.
If a provision is held invalid or unenforceable, the remaining provisions continue to apply to the extent they can operate lawfully. No provision will be interpreted to remove a right or remedy that applicable law protects from waiver.
18. Changes to these terms
We may update these Terms for future transactions by posting a revised version with a new effective date. The version provided and accepted when you authorize a service order continues to govern that order unless both parties expressly agree to a lawful written amendment. A later website update does not retroactively reduce an existing warranty or add charges to previously authorized work.
